Terms and condition of business for the construction and installation of Aquariums.
The company The Mini Reef Custom Aquarium Company ltd is the manufacturer or supplier of aquariums referred to in the terms of business.
(1)The terms and conditions relate to the conversion of standard aquariums to marine systems manufactured by other companies to meet Health and Safety regulations. In particular those aquariums manufacturer under the trade name Juwel Aquariums or Rene Aquariums. Aqua one.
(2) The terms of business relate to those aquariums constructed by The Mini Reef Custom Aquarium Company Ltd or any authorised sub contractor employed by the company.
(3) All Aquariums manufacturer by the company or any authorised Sub Contractor will be constructed in a manner standardised within the UK industry and conforming to Health and Safety Regulations.
The thickness of the glass and manner of construction will be defined by the company and follow the design method appropriate to the UK industry.
The Aquarium will be cured at a rate of 1mm thickness of glass per day and will then be water tested for a period of five days before delivery or in the event of an on site builds
Placement of Order
Under the 2000 EEC regulations for long Distance selling. The customer has the right to cancel the order within seven days of placing the order and to receive a full refund.
Under section 13 of the act. After the initial 7 days.The customer does not have the right to cancel the order if the product is custom made or modified to meet the customer's specification.
Installation.
(1) The Customer/Contractor/Architect is entirely responsible for the supply of electricity to the point specified by the company and provides any sockets or spurs deemed necessary. That the electrical supply will conform to Health and safety regulations and that the supply will be connected to a separate suitable RCD fuse on the fuse board.
(2) The Customer/Contractor/Architect is entirely responsible to provide a suitable supply of water to a specification provided by the company.. Together with any drainage required for the installation of a Reverse osmosis unit.
(3) Where the size and weight of the aquarium would incur a breach in the Health and Safety regulations the aquarium will be constructed on site. 25k weight maximum per man.
(4) In regard to standard practice the curing process of one day per 1mm thickness of glass will apply. No water will be added until this process is completed.
(5) All drawings.scetches and detailed specification unless in breach of health and safety regulations will deem to be the basis of the contract with the Customer/contractor or Architect.
(6) In compliance with Health and Safety regulations the company will provide a copy of its Public Liabity insurance (AXA) Method statement Risk assessment and details of any chemicals solvents used on site.
(7) The customer/contractor/architect is entirely responsible to ensure the floor/base for the aquarium meets the legal requirements in regard to load bearing and to be level over the entire surface plus or minus 5mm.
Delivery
(1) The responsibility to provide free and appropriate access to the premises is entirely the responsibility of the Customer/Contractor or Architect.
(2) That suitable provision is provided to the installers to operate the construction process in a safe and adequate environment.
(3) That adequate ventilation is provided in the use of solvents and sealants used in the construction of the aquarium.
(4) Those only company employees are authorised and insured in the movement and construction of any equipment provided by the company.
(5) The company reserve the right to charge a mileage charge of 75p per mile and an hourly rate of £25 per hour. Emergency call out for out of hour's rate at £40 per hour.
Breach of the regulations.
(1c) In the event of any drawing or instruction provided by the customer/Contractor or Architect is in breach of health and safety regulations the company reserve the right to decline those instructions. A resolution notice will be provided to the customer/contractor/architect and failure to comply will terminate the agreement.
(2c) any alteration, modification or adjustment of the Aqurium, filteration system supplied by the company will automatically terminate any guarentee/warenty or liability on the part of the company.
(3c) In the event of the contract being terminated by the Customer/ Contractor/ Architect the Guarantee/warranty and liability becomes terminated. Payment is due on demand. For breach of contract
(4c) A deposit of 50% of the agreed contract price is due in advance and is non refundable on the grounds that this work is entirely to the customer/contractor or architects specific specification and may have no saleable value. Stage payments may need to be negotiated depending on the value of the contract. This complies with 2000 Section 13 of the Long distance selling act introduced by the EEC,

(5c) All property supplied and installed by the company remain the property of the company until paid in full. The company reserves the right to remove such property.
(6c) No live stock will be added to the Aquarium until such time as the company is satisfied the system is sufficiently mature to provide life support to such live stock. In the event of the Customer/Contractor or Architect over ruling this condition it will be so entirely at their own risk.
The terms and conditions provided in this document conform to the Health and Safety regulations currently in force in the United Kingdom.
